State of Georgia,

County of Banks.

In person came before me, the undersigned Ordinary in and for the County of Banks Mrs. E. L. Caudell, who being sworn according to law, says under oath that she is the widow of Wilburn M. Caudell, who was a soldier in the service of the Confederate States, and served as a member of Company D, of the 42rd Regiment of Georgia Volunteers; that he enlisted in said services on or about [blank] day of March 1862, and was in the Western Army up to the 26th day March 1865.  That while in the Army, he was on the 15th day of March 1865,

“Attacked with measles and when he became better was ordered to enter the service again which caused a relapse.  Measles settled in his lungs causing consumption of the lungs which resulted in his death in June 29th 1872. [Wilburn M. Caudell is listed in the 1880 Banks county census-he may have died in 1882.]  He got worse after he was brought home and from the consumption so contracted he died as stated.  He was healthy and perfectly free from consumption when he entered the service.  None of his ancestors ever had consumption.

Deponent further swears that she was the wife of said deceased soldier during his term of service in the Army, and that she has never married since his death; that she became his wife on the 28th day of April 1858, and that she was born in 9th May 1834 and that Georgia is her home, and was such on 23rd December, 1890, and since said date she has not lived in any other State or locality.  Deponent, as the widow of said deceased soldier husband, applies for the pension provided by Act of the General Assembly of Georgia, approved December 23d, 1890, for the pension year ending February 15th, 1897, and herewith tenders the proof of her right to receive the pension granted by said Act.

Signed: E. L. Caudell [X her mark]

Sworn to and subscribed before me, this the 15th day of March 1897.
